摘要:
随着网络科学技术的发展,网络犯罪案件数量逐年上升。网络犯罪案件具有的犯罪行为无形性、跨区域性以及犯罪方法的智能性等特点,使得刑事侦查产生取证难、固定证据难、侦查协作效率低、侦查工作监督难等问题。现阶段,区块链技术已经应用于刑事侦查领域。区块链技术能够有效地帮助侦查部门解决司法实践中的侦查难题,但是区块链技术在侦查领域的应用,也给侦查工作带来挑战。区块链侦查存在缺乏程序规范、缺乏权利保障制度等问题,应当通过完善刑事侦查中区块链运用程序和权利保障制度,规范区块链技术在刑事侦查中的运用。
Abstract:
With the development of network science and technology, network crime cases are increasing year by year. Due to the characteristics of intangible and cross-regional criminal acts and intelligent crime methods, there exist problems in criminal investigation, such as difficulty in obtaining and fixing evidence, low efficiency in investigation cooperation, and difficulty in supervising investigation. At present, blockchain technology has been applied in the field of criminal investigation. Its advantages can effectively help the investigation department to solve the investigation problems in judicial practices. However, the application of blockchain technology in the field of investigation also brings challenges to the investigation work. Blockchain investigation lacks procedural norms and rights protection system. The application of blockchain technology in criminal investigation should be standardized by improving the blockchain application procedure and rights protection system in criminal investigation.
