摘要:
公法变迁的狄骥范式可以整理为：专门研究公法变迁的原因在于范式转换的意义辨析，研究基础在于方法上的功能主义，法律体系制度背景是公私法的协同演进，社会背景是公法问题与社会学方法的关联，公法的核心观念从国家主权变迁为公共服务，公法体系要素的变迁影响了现代公法理论的结构与内容，公法变迁的公法理论脉络呈现为公共服务理论的兴起和影响。
Abstract:
The Léon Duguit paradigm of public law transition can be sorted as: the reason for studying the change of public law transition lies in the analysis of the meaning of paradigm shift, the research foundation is the functionalism method, the background of the legal system is the coordinated evolution of public and private laws，the social background is the relationship between public law and sociological method, the change of the core concept is from national sovereignty to public service, the change of the elements of public law system affects the structure and content of the modern public law theory, and the theoretical context of public law transition demonstrates the emergence and influence of public service theory.
