摘要:
根据《国际湿地公约》对湿地的定义可知, 河流、湖泊、沼泽、珊瑚礁以及水库、鱼( 虾) 塘、水稻田等人工湿地都应 属该公约范畴。现行湿地保护地方立法在我国原有的立法经验基础上将永久性水稻田等人工湿地纳入湿地保护的范围, 实现了对 湿地的全面保护。生物入侵已给我国造成重大损害, 在目前生物入侵防治立法缺位的情况下, 地方立法对湿地外来物种的引入作 出了严格规定。为了解决环境保护违法成本低的难题, 应提高湿地违法行为的处罚额度, 并与地方经济水平和行为人的违法所得 相结合。
Abstract:
Acco rding to the definition o f w et lands in the Internatio nal Convent ion on Wet lands , rivers, lakes, sw amps, cor al reefs and reserv oirs, f ish ( shr imp) po nds, paddy fields and other ar tif icial w etlands should be considered as w et lands. Based on the prev io us law ex perience, the ex ist ing w et land pro tection legislat ion put s permanent paddy f ields into the scope of w et land protect ion to achiev e comprehensive pr otect io n of wet lands. Biolog ical invasio n has caused sig nif icant harm to our count ry . Lack of the bio logical inv asion cont rol leg islat ion, the local legislat ion st rictly rest rict s the intro duct ion of alien species into w et lands. In or der to solve the pr oblem of the low co st of illegal damag e to enviro nment , the fines of w et lands damage penalt ies should be r aised, w hich should be in acco rdance w ith the level of lo cal economy and the illegal income of the violator .
