摘要:
根据侵犯行为客体的不同, 民事责任通常分为侵权责任和违约责任两大类。在旅游纠纷中, 违约责任和侵权责任的竞合 在旅游合同关系中极易发生, 两类责任在归责原则、举证责任、构成要件、赔偿范围等方面又存在着较大的差异, 两类责任的不 同选择将极大地影响到旅游者的利益。分析旅游损害赔偿中违约责任与侵权责任竞合产生的法律原因、出现情形以及法律上的有 关规定有利于帮助旅游者有效行使请求权。
Abstract:
The liability for tort s and the liability fo r breach of co nt racts are tw o kinds of fundamental civil liability. The co nduct that possesses dual character of breaching o f cont ract and infringing of right w ill cause the concurrence of liability. It is clear ly provided in “the Contract Law ”that the victim has the right to choose his favorite liability to claim. In trav el damag e, tourist practicing his differ ent claims w ill engender differ ent leg al consequences. We should therefore st rict ly def ine the boundary betw een l iabilities for breach of cont ract and liabilit ies fo r tort and be cautio us abo ut the concurrent in or der to proper ly per form “t he select ion of claim of co ncurr ent”.
