摘要:
刑事法律援助在法律援助中应居优先地位; 有质量保证的刑事法律援助才为有效; 我国目前的刑事法律援助因责任主 体定位不准、尚无质量标准、整体刑事辩护司法环境不佳、未实行服务主体的准入制度、刑事法律援助质量监控不力等因素而 质量不高。应当构建刑事法律援助质量保证体系，制定质量标准和操作规程，实行服务主体准入制度，建立律师名册，在人大 常委会设立监督机构，加强外部监督，在法律援助机构设立内部监督机构，加强内部监督，实行质量考核和奖惩制度。
Abstract:
The criminal legal aid should be given priority in legal aid． We must guarantee the quality of the criminal legal aid if we want to make it effective． At present，the reason why the quality of China＇s criminal legal aid is not so good lies in that China＇s criminal legal aid is short of quality standard． We must set up the quality guarantee system of the criminal legal aid，formulate a quality standard，carry out an access system，establish a supervisory mechanism，carry out a system of quality assessment and reward and punishment．
