摘要:
《物权法》创设了业主撤销权, 用于弥补物业管理区域内业主大会或业主委员会民主决策制度的缺陷, 有力地保障了个 别业主的合法权益; 业主撤销权的行使应当判断业主大会或业主委员会作出决定的程序是否合法, 同时并非所有的业主均可行使 业主撤销权; 应建立业主大会或业主委员会决定作出前与相关业主的磋商、补偿制度; 业主撤销权的行使应当设最长期限; 业主 撤销权行使的效力不应及于第三人。
Abstract:
The Property Law establishes the owners' right to rescind, adopted to make up for the limitations of the Assembly of Owners or the limitations of the system of democr atic decision- making by the Commission of Owners in the domain of property management, has effectively guaranteed the lawful rights of cer tain individual owners. In exer cising the right of rescission, whether the process of decisionmaking by the Assembly of Owners or Commission of Owners is legal or not must be taken into consideration. Meanwhile, not all the owner s can exercise the right of rescission. Negotiation and compensation systems with the owners concerned should be set up before making decisions by the Assembly of Owner s or the Commission of Owners; the maximum duration wherein the owners can exercise their right of rescission be set up; and the owners' right of exercising right of rescission shall not be assigned to any third party.
