摘要:
法国存在着两个法院系统, 即普通法院系统和行政法院系统。普通法院属于司法机关, 而行政法院隶属于行政机关, 是 行政机关的一部分。但行政法院并没有丧失其独立性和司法性, 由于其在行政和司法领域的高度专业性, 政府官员认为行政法官 在行政领域是专家。行政法官的成功得益于法国行政法官专业化培养模式。我国行政法庭的建设和行政法官的专业化培养方面还 处于起步阶段, 行政法官的专业化培养需要探索我国的本土化培养模式。
Abstract:
There are two court systems in France, that is, ordinary court system and administrative court system. Common court s a re the judiciary, a nd admini st rativ e court s belong to the g ov ernment, a nd are part of admini st rativ e o rgani zatio n. Admini st rativ e court s, however, do no t lo se thei r independence a nd judicial because of ficials believ e that the administ ra tiv e judg e is an ex pert in the area o f admini stration owing to thei r highly professio nal ski lls in th e field of admini st ratio n and jury. The success of the administ rative court in France co nt ributes to the speciali zed t raining model of the admini strativ e judg e. On the other hand, the construction of China 's admini strativ e cour ts a nd the speciali zed training of administ rative judg e i s being at the stag e of ex plo ra tio n. And w e should t ry to ex plo re a local training model of speciali zatio n of the admini st rativ e judge w ith Chinese cha racteristics.
