摘要:
旅游法的立法宗旨、名称、调整范围及其与旅游管理体制改革的关系是旅游法立法必须思考的几个基本问题。由旅游活 动的多重性及其本质所决定, 旅游者主权理念应成为未来旅游法的立法宗旨, 旅游法应合理确定其调整范围, 以突破产业立法的 狭隘思路, 并积极推动旅游管理体制改革。
Abstract:
The p rincipal aim of legislat ion, the name, the regu lat ing scope and the relat ion sh ip betw een the tou rism law and the tou rism regu lato ry system refo rm s are essen t ial issues concern ing the legislat ion of the tou rism law. Determ ined by the mu lt i- aspect s of tou rism and it s natu re, the idea of tou rist sovereign ty shou ld be the p rincipal aim of legislat ion in the tou rism law and the regu lat ing scope of the tou rism law shou ld be reasonab ly determ ined in o rder to go beyond the narrow view of the indu st ry lit igat ion. It shou ld also pu sh fo rw ard the refo rm s of the tou rism regu lato ry system.
