摘要:
新时代的校园欺凌治理已经上升为国家意志与政府行动,一方面在运动式的专项治理过程中总结防治经验、形成工作模式,另一方面在分散型的法律体系内容中进行法理论证、探寻规制路径。校园欺凌治理的法律的空白与规则缺位,使其在实践中遭遇了学校“介入无门”与“权小责大”的法制困境,继而在从“政策议题”过渡至“法律命题”转换过程中,需要借助于法的威权及强制力,赋予校园欺凌治理的策略和方法以合法性,明晰各类相关责任主体的角色扮演、权力分配与能力需求。通过专项立法、有序衔接,实现校园欺凌依法治理; 强调学校为主、多元协同,推进校园欺凌综合治理; 依靠配套机制、纠偏持正,实施校园欺凌精准治理。这些都是建构校园欺凌治理制度框架的有效途径。
Abstract:
The governance of school bullying has risen to the national will and government action. On the one hand, it summarizes the prevention and control experience and forms a working model in the movement-type special governance process. On the other hand, it expounds jurisprudence and explores regulations and paths in the content of the decentralized legal system. The legal blankness and regulatory absence of school bullying have caused the legal dilemma of “intervention without reason” and “little power but great responsibility” in governance practices, then in the transition from “policy issue” to “legal proposition”, the authoritative power of law and its coercive force are needed to give legitimacy to the strategies and methods of school bullying governance, to clarify the role play, power distribution and ability requirements of various relevant responsible subjects. Through special legislation and orderly connection, school bullying can be governed according to the law. Emphasizing the main body of the school and diversified cooperation to promote the comprehensive management of school bullying and relying on supporting mechanisms and correcting bias to improve the precise management of school bullying are effective ways to construct the framework of school bullying governance system.
