摘要:
城管综合执法改革已经成为新时期国家治理改革的重要内容。传统的管制思维对于我国城市管理综合执法的制度设计、体制安排和执法活动有着重要的影响和制约。随着这种管制思维越来越不适应现代城市经济、社会和法治发展的需要,现行的城管综合执法制度也陷入诸病缠身、进退失据的窘境。要摆脱这种窘境,首先要实现从管制思维向治理理念的转型,树立城管综合执法中的多主体合作共治的理念、多元价值和利益平衡的理念、依法行政和正当程序的理念。同时,要在治理理念的指导下实现城管综合执法的制度创新,主要包括管理体制的法定化与协调化、参与主体的多元化和管理职能的社会化、执法程序的规范化与裁量标准的明细化。
Abstract:
The reformation of comprehensive law enforcement in urban administration is an important content of national governance reformation in the new period, but the traditional control thinking has important influence and restrict to comprehensive law enforcement in urban administration in the aspects of system design, institutional arrangements and law enforcement activities, the control thinking increasingly cannot adapt to the economic, social and legal development of modern cities, and has made the current comprehensive law enforcement in urban administration system in the disease -ridden, equally difficult to go on or retreat dilemma. To get rid of this dilemma, first of all, we should realize the transformation from the control thinking to the conception of governance, and establish the conceptions of multi-agent cooperation, multi-value and interests balance, law-based administration and due process in comprehensive law enforcement in urban administration. At the same time, we should achieve a comprehensive system innovation of comprehensive law enforcement in urban administration under the guidance of the concept of governance, mainly including legalization and coordination of management system, diversification of participating subject and socialization of management functions, standardization of law enforcement procedure and the detail of discretion standard.
