摘要:

刑法修正案( 八) 已设立“危险驾驶罪”, 但危险驾驶机动车的行为尚未达到应受刑罚处罚程度; 目前的法律手段能够 达到预防、减少危险驾驶机动车行为, 保护人民群众的生命、健康和财产安全的目的; 没有充分的根据说明设立“危险驾驶罪” 是民意, 即使是民意, 也未必是设立“危险驾驶罪”的充分理由; 设立“危险驾驶罪”将大大增加社会成本, 与我国现有刑法原 则精神和现行刑法规定不协调。

Abstract:

T he new ly amended Criminal Law ( Eig ht ) has def ined “Hazardous Driving ”as a criminal o ffence, but the act of drunk driving itself does not necessarily result in a t raf fic accident so as to be convicted. The legal means befo re this amendment can serv e the purpose of deterring people f rom drunk driving and pro tect ing the life, health and proper ty of human beings. T here is not suf ficient ev idence that the new amendment is the result in respo nse to the public call . Ev en if it is, it is far f rom just if ied. The new o ffence of hazardous driving is going to increase cost s on the social resour ces and is not in line w ith the co unt ry' s present judicial principles and the criminal law , and so makes it diff icult to handle specif ic cases.
