摘要:
并存的债务承担与免责的债务承担是债务承担两种类型。学界对免责债务承担讨论颇多, 而对并存债务承担尤其是其效 力依据语焉不详。连带责任产生的法律依据应为法律明定或者当事人约定, 连带责任所产生的效力对于并存债务承担适用有其缺 陷, 因此并存债务承担以连带责任作为效力依据值得推敲, 并存债务承担中应废弃连带责任作为效力依据, 改采不真正连带责任 更符合法理及司法实践
Abstract:
The coexi stence o f debt assumption and the exemptio n o f debt assumption are tw o di fferent debt assumptio ns. Much about the exemption of debt assumptio n has been di scussed in the academic field. The coexistence o f debt assumptio n, how ev er, has not been referred. The legal basi s of joint liability may be judg ed by law o r prescribed by the pa rties. There are, how ev er, some defectiv es for the co exi stence of debt assumptio n by joint liability as the effect foundatio n. It is therefo re w or thwhile to reco nsider that as joint liabi li ty to the basic o f the co exi stence o f debt assumptio n. And the coexistence of debt assumption should abolish joint liabi li ty as the theo retical foundation and use unreal joint liabi li ty to make i t mo re reaso nable and acco rd to the judicatory practice instead.
