摘要:
美国《濒危物种法》的立法宗旨体现其先进的环境立法理念, 造就其凌驾于行政之上的濒危物种优先权、广泛的保护范 围和强大保护效力和公民诉讼制度等, 使其成为世界范围内最强有力和卓有成效的物种保护法律, 为物种的持续生存提供坚实的 法律保障。中国应借鉴美国经验, 重新审视其环境立法理念, 并在此基础上进一步完善野生动物资源保护的地位、立法目的、法 律责任及司法保证等, 以期切实有效的保护本国生物多样性。
Abstract:
T he legislat ive pur pose of the Endang er ed Species Act in Amer ica ref lect s its advanced enviro nmental leg islat iv e co ncept , determines the pr io rity o f endang ered species ov er g overnmental administ rat ion, the Act' s ex tensiv e protect ion range and intensive protect io n force and cit izen suit s sy stem as w ell . Al l these make the Act o ne of the mo st ef fect ive ones concerning species pr otect io n, providing a so lid support for the species' cont inuous ex istence. China should lear n fr om American ex perience to effect iv ely conserve the biodiversity of the count ry by rev iew ing it s present environmental legislat ive co ncept and r econsider the issues o f leg al status, legislativ e purpose, legal l iabilities and judicial assurance of natural resources protect ion law s.
