摘要:
《劳动合同法》关于劳务派遣制度的规定仍然存在一些不足。在劳务派遣单位的资格限制方面, 缺乏配套的保障制度; 在 劳务派遣单位和用工单位的连带责任方面, 规定得过于笼统; 在派遣期限方面, 缺乏明确的限制。应增加劳务派遣单位资格的配 套性规定, 合理划分派遣单位和用工单位在连带责任中的主次责任, 明确劳务派遣的最长期限。
Abstract:
There are some defect s abo ut the new pr ovision of labor services dispatching sy stem in the labor co nt ract law : being lack o f matched g uarantee system in dispatching org anizat ion's qualificat ion limit ; the pr ovision is ambig uo us in respect of joint r esponsibility betw een dispatching organizat io n and emplo yer, and lacking definite limit in dispatching deadline. To consummate the system, the legislators should increase the suppo rt ing prov ision of dispatching or ganizat ion's qual if icat ion, dist ribute the pr imary and seco ndary responsibility in joint r espo nsibility betw een dispatching org anizat ion and emplo yer rat io nally , and def ine the lo ng est term of dispatching .
