摘要:
《刑法修正案(六) 》第二十条规定了依法承担仲裁职责的人员的刑事责任, 司法解释称本罪为“枉法仲裁罪”。确立 “枉法仲裁罪”增强了司法对仲裁的控制, 可以有效地预防和惩罚仲裁中出现的枉法行为, 但是由于仲裁本身性质的特殊性, 该 罪的出现也引起了仲裁界人士的非议, 加上本罪的规定还存在一定的漏洞和不足, 所以对本罪的司法适用及其过程中出现的问题 进行研究是非常必要的。
Abstract:
The arb it rato r’s crim inal legal respon sib ility fo r h is inapp rop riate arb it rat ing conduct, called “law - bending arb it rat ion”in the judicial in terp retat ion s, has been passed in A rt icle 20 in Amendmen t V I to the Crim inalA ct of the Peop le’s Repub lic of Ch ina and it can bu ild up the judicial con t ro l of arb it rat ion, and p reven t o r pun ish the bending do ings in arb it rat ion effect ively. It, on the o ther hand, has b rough t abou t con t roversy w ith it s com ing in to being and ob jected by the arb it rat ional f ield becau se of the un ique natu re as w ell as some legal loopho les and lim itat ion s in the law it self. Therefo re, it is necessary to research the p rob lem s in the app licat ion of law - bending arb it rat ion.
