摘要:
根据国家机关的性质和单位犯罪的原理, 国家机关不应成为单位犯罪的犯罪主体; 从历史和比较法的角度, 加上必然存 在的理论和实践困难, 国家机关不应成为刑事诉讼的被告; 国家机关承担责任的形式只有国家赔偿和国家补偿两种, 国家机关不 应承担刑事责任。
Abstract:
Acco rding to the nature of sta te administ ra tiv e departments and the principle of enterprise crime, f rom the a ngle of histo ry and the compa rative law , wi th dif ficulty in theory and practice, the state administ rative depar tment shouldn 't become the defendant of crime. There are o nly tw o w ays fo r the state to take respo nsibiltiy: sta te indemnificatio n a nd state compensa tion; the sta te admini strativ e depar tment shouldn 't take crimal liabi li ty; the civil liablii ty should take as state liability. The state admini st rativ e department only takes crimal liability in international law s.
