摘要:

我国刑事诉讼中的证明标准采客用观证明标准, 但目前在理论上和操作上都呈现出诸多困境, 通过比较分析, 用“法律真 实” 来界定证明标准的性质比较合适, 在此指导之下, 并兼顾我国目前的立法、司法实际状况, 对证明标准进行了全新表述, 将 其分为理想的选择—— “排除合理怀疑” 标准和现实的选择—— “确定无疑” 证明标准, 理想的证明标准应遵循司法公正与诉讼 效率兼顾的基本思路, 从多角度、多层次、体现诉讼阶段性来构建一个系统化的刑事证明标准体系。

Abstract:

In our co unt ry the standard o f proo f in criminal pro secution i s based o n facts, but at present there exi st many dif ficul t posi tio ns in theo ry and operatio n. It is a ppropria te to define the nature o f the sta nda rd of criminal pro of o n the basis of the reality of law . On this principle and wi th more a t tention to the present legi slation and judicial system, the author has made a brand- new ex pression o f the standard o f proof. The standard o f pro of is divided into tw o choices: the ideal choice— “ the standard o f removing reaso nable doubt" a nd the realistic al terna tive— " the sta nda rd of determining the pro of w itho ut do ubt". The ideal standa rd o f proof sho uld fo llow the principle o f fai r judgment wi th proper a t tention to the ef ficiency of law sui t. A sy stematic standa rd o f criminal proof can be co nst ructed wi th multiple perspectiv es, multi- lev el s a nd mani festatio n of the stages of law suit.
