摘要:
人权是指人作为人应该享有的权利, 是一个人在社会中应享有的政治、经济和文化等各项权利的总称。人权可分为个人人 权和集体人权, 其存在状态包括应有权利、法定权利和实有权利。在应有权利向实有权利转化的过程中, 政府起着关键的作用。 从保障个人人权的视角看, 衡量一国政府是否在认真地对待人权, 主要看其是否遵循平等原则和自由原则。
Abstract:
The human righ t s are to be shared by every human and con tain po lit ical righ t s, econom ic righ t s and cu ltu ral righ t s and so on . They can be classif ied in to individual human righ t s and co llect ive human righ t s. They ex it as natu ral righ t s, law fu l righ t s and p ract ical righ t s. W hen the natu ral righ t s tu rn in to p ract ical righ t s, the governmen t p lays an impo rtan t ro le. F rom the viewpo in t of safeguarding individual human righ t s, w e can judge w hether o r no t a governmen t takes human righ t s seriou sly depending on w hether o r no t it fo llow s the p rincip le of equal impo rtance and the p rincip le of f ree respon sib ility.
