摘要:
生命权本体无民事救济权, 是文明社会法律的遗憾, 对死者近亲属的救济水平极低在实践中危害极大。造成这种现象的原 因是民法理论中著名的“悖论”和一些不合理的观念。本文针对以上现象, 本着加强对生命权的保护和救济的目的, 论证了死者 应当具有救济权、死者近亲属行使双重救济权、精神损害充分赔偿、统一赔偿等等完善生命权救济理论的观点。
Abstract:
It is a pity that the right to life it self has no relief right in the law of civilized society . T his result s fr om the w r ong co nclusion and unreasonable concept s in civil law . T he art icle argues that , in o rder to protect life r elief r ig ht s, the dead should have rel ief right s and that the close relat ives of the dead should exercise double relief right s, full compensat ion fo r spir itual damag e and unified compensat ion, etc. thus perfect ing the life r elief right s.
