摘要:
犯罪过失的本质在于具有注意义务的人对注意义务的违反。注意义务是我国刑法规定的“应当预见” 的另一层涵义, 注意 义务是过失理论中比较重要的问题, 争议颇多。本文围绕注意义务相关理论作了探讨。
Abstract:
The essence o f o ffence through neg ligence lies in the violatio n o n the par t of peo ple w ho bear the a ttention obligation. Acco rding to the Criminal Law o f our count ry, at tentio n oblig atio n i s alternativ e ex planatio n of " ought to fo resee ". Attention o blig atio ns is a ra ther impo rtant i ssue in the theory of neglig ence. a nd there a re co nt roversies over i t. Thi s a rticle t ries to probe into some rela ted theories about a ttention obligation .
