摘要:
民营经济已经成为社会主义市场经济的重要组成部分。民营企业在发展中面临产权中的法律风险、企业设立时潜在的法 律风险、合同签订和履行中的法律风险、融资中的法律风险及商业秘密保护中的法律风险。民营企业要化解法律风险: 规范公司 的设立行为, 明晰产权; 提高防范法律风险的意识; 合理评估企业法律风险, 建立风险防范机制; 建立专兼结合的防范法律风险 的人才队伍以及加大对防范法律风险的投入等。
Abstract:
Private - ow ned economy has become the major part of socialist market economy. During it s developmen t, how ever, many risk s arise, such as risk s related to ow nersh ip , the po ten t ial risk s of en terp rise estab lishmen t, of con t ract signatu re and enfo rcemen t, of f ianance, as w ell as of of bu siness secret p ro tect ion. In o rder to so lve the p rob lem , some measu res shou ld be taken: regu lat ing the conduct s of company estab lishmen t, mak ing clear the p roperty righ t, imp roving the aw areness of legal risk p reven t ion, reasonab ly assessing legal risk s of the en terp rise, estab lish ing the mechan ism of risk p reven t ion, con st ruct ing a team w ith p rofessional and ex t ra p ract it ioners and increasing the budget of risk p reven t ion.
