摘要:
我国社会保障立法建设已历经半个多世纪, 对于促进我国经济稳定发展和社会长治久安发挥了重要作用。然而, 随着时 代的进步变迁, 尤其是随着宪法的修正完善、市场经济的逐步建立和世界经济发展一体化, 完善我国社会保障立法已成为当务之 急。当前, 我国社会保障法律制度严重滞后, 存在着诸多亟待解决的问题, 迫切需要通过确立社会保障立法的基本原则、构建多 层次的社会保障立法体系、解决与其他法律部门的立法衔接等路径加以健全完善, 为构建我国社会保障制度提供充分的法律支 持。
Abstract:
Social securi ty i s o ne o f the most impo rta nt natio nal basic systems, a nd sturdy legislatio n of social securi ty i s the“ staunch suppo rter” of social security sy stem. The co nst ructio n o f legisla tion of social securi ty in China has go ne through more than half a century a nd play s an impo rtant role in promoting sta ble dev elopment o f economy and long period of poli tical stabi li ty. It i s, how ev er, o f g reat necessi ty to perfect legislatio n of social security, wi th the development and cha ng e o f society, especially the amendment and perfectio n of consti tution, the prog ressiv e establi shment o f market eco nomy as w el l as the uni ty o f w o rld economy dev elopment. Current ly , the problem of social security system of our co unt ry is serio usly backwa rd, and many pro blems need solving. In order to supply law suppo rt for establishing social security syste, w e sho uld establi sh fundamental principles of legislatio n o f social securi ty , establish mul ti- storey sy stems and reali ze legislatio n engag ement wi th other law departments.
