摘要:
随着教育改革的不断深入, 高校已逐渐成为自主办学的法人实体, 政府与高校管理者之间形成委托代理关系, 存在着多 种治理结构方面的问题。构建科学的高校法人治理结构, 规范委托代理各方之间的关系, 是十分必要的。要进一步明晰高校的产 权; 理顺政府与高校的关系, 落实高校办学自主权; 建立高校内部的有效运行机制。
Abstract:
As the educat ional reform has g one fur ther and further on it s way , universit ies hav e gr adual ly become leg al units which run their educat ion independently. A t rust - and - clientag e relat ionship has fo rmed between the gov ernment and university administr ator s, w hile pro blems on go ver nance st ructure still ex ist . The const ruct ion of leg al g overnance str ucture and standardizat ion of the t rust - and- clientage relatio nship are the major problems w hich r equire an urg ent so lut ion. Primarily, the ow nership of universit ies must be fort ified. Seco ndly, the focus of administ ration should be low er, and the independence of univ ersity educat ion sho uld be fulf illed. Besides, it is necessary to create boards of t rustees so that the pr oblem on the connect ions betw een the gov ernment and univ ersity administr ato rs can be so lved.
