摘要:
《执行异议复议规定》对一般不动产买受人物权期待权,已经有了相对明确的规定。笔者结合《九民纪要》的相关内容,对2017年至2020年中国裁判文书网上公开的一般不动产买受人基于物权期待权而提出执行异议的案件进行分析后发现:因目前并未有和物权期待权理论相适应的立法方案及规则体系,以及实务实践中案件情况较为错综复杂,导致《执行异议复议规定》第二十八条在适用时会面临诸多困境。现尝试从分析一般不动产买受人物权期待权概念、性质及立法现状入手,结合相关案例,对《执行异议复议规定》第二十八条构成要件及其适用进行思考探讨。
Abstract:
The Provisions of the Supreme People’s Court on Several Issues Concerning the Handling of Cases of Execution Objection and Reconsideration(hereinafter referred to as Regulations of Execution Objection and Reconsideration)have relatively clear provisions regarding the anticipation right of property right of general real estate purchasers. Based on the relevant contents of the Minutes of the National Court Civil and Commercial Trial Work Conference(the Ninth)(hereinafter referred to as the Jiumin Minutes), through the analysis of cases of execution objection filed by general real estate purchasers according to the anticipation right of property right published in China Judgment Online from 2017 to 2020, it is found out that currently, there is no legislative plan and rule system compatible with the theory of the anticipation right of property right, and the case situation in practice is complicated, which leads to the difficult application of the 28th Article of Regulations of Execution Objection and Reconsideration. Starting with the concept, nature and legislative status quo of the anticipation right of property right of general real estate purchasers, combined with relevant cases, the constituent elements of the 28th Article of Regulations of Execution Objection and Reconsideration and their application are reflected and discussed.
