摘要:
长期以来, 争议事项是否具有可仲裁性被视作仲裁协议的有效要件之一。从实质上来说, 争议事项可仲裁性与仲裁协议 的效力是与仲裁管辖权相关的两个独立的问题。厘清两者的关系有助于将争议事项可仲裁性的认定权交由仲裁庭, 推迟法院介入 仲裁的时间并减少法院介入仲裁的可能性, 使仲裁更少、更晚地受法院的干预和影响。这也恰恰符合了当前减少对仲裁的司法监 督的发展趋势。
Abstract:
Arbit rability has been reg arded as one of the ef fectiv e essent ials of ar bit rat io n agr eement for a long t ime. Virtually, arbit rability and the validity of arbit ration ag reement are tw o separate issues. Clarify ing the connect ion o f bo th w ill help to save the rev iew ing pow er of arbitr ability to ar bit rat io n t ribunal. Thus, it w ill defer the time and the possibility of court' s interventio n and make the ar bit rat io n suf fer the co urt ' s intervent ion and infect io n much less and later. It exactly answ ers for the t rend of decreasing judicial supervision in the arbitr at ion.
