摘要:

商业秘密权没有经过审查、公告等行政程序, 权利具有主观性、不确定性, 其专有性和排他性应受到严格限制。侵犯商 业秘密罪的立案阶段, 为确认受害人持有信息“不为公众所知悉” , 应要求其提供相应的“评价报告” ; 对有关知识产权侵权对比 文书“鉴定报告” 的内容也须逐步规范, 排除对“不为公众所知悉” 内容的鉴定; 违法事实证明阶段, 应由受害人承担与民诉相 同的举证责任, 公权力机关仅保障刑事强制措施的合法实施, 唯有如此, 方可有效地保护商业秘密, 维护公平竞争的市场秩序。

Abstract:

The business secret rig ht wi thout passing through administ ra tiv e procedures of examinatio n a nd anno uncement is of subjectivity and uncer tainty and i t s appropria tio n and ex clusiveness sho uld be st rictly rest rained. In the trial stage of inf ring ement business secret crime, the co rrespo nding o riginali ty “ the retriev al to repo rt” sho uld be requi red to provide to co nfi rm tha t the victim has the info rmatio n “ no t to learn abo ut fo r the public” ; mea nw hile, the co ntent of “ the appraisal reported” of related intellectual property righ ts should be g radually sta nda rdi zed, remov ing “ does no t learn abo ut the co ntent apprai sal fo r the public” ; in the criminal pro secution evidence stag e, the victim sho uld under take the same estimatio n as sues in a civil actio n, and the civ il righ t st reng th institution o nly pro tects the legi tima te implementatio n of the precautio nary measure. Only in this w ay , the business secret ca n be ef fectively protected a nd the fai r competi tion of the ma rket o rder can be maintained.
